How Do Divorce Attorneys Charge?

Clients are billed for the actual hours worked, including meetings, phone calls, research, and court appearances.
  • Flat Fee: In some cases, attorneys may offer a flat fee for specific services related to the divorce process. For example, a flat fee may cover the preparation and filing of divorce paperwork or representation at a specific court hearing. This arrangement provides clients with a clear understanding of the cost upfront. We may also provide a flat fee quote if requested for the totality of your case. This is an option we provide in some instances.
  • Retainer: Attorneys often require clients to pay a retainer fee, which is an upfront payment to secure the attorney’s services. This is not the total cost of the case but is simply a prepayment for work to be performed. The attorney then bills against this retainer as they work on the case. Once the retainer is depleted, clients may need to replenish it to continue receiving legal services.

At The Smith Firm, we primarily charge by the hour for our legal services in divorce and family law cases and require a retainer to begin representation of the client. Our hourly rates are competitive with the market based on the experience and reputation of the attorneys involved, and the retainer serves as an upfront payment to cover the initial work on your case. Throughout the legal process, you will be informed of the hours worked because we bill twice per month, and any unused portion of the retainer will be returned to you at the conclusion of your case. This approach allows for transparency in billing and ensures that clients are aware of the financial aspects of their legal representation.

It’s important to note that several variables can impact the overall cost of a divorce case. Factors such as custody issues, complicated property division, and contentious negotiations can contribute to higher legal fees. A case will be as expensive as either side wants to make it.
